Immigration Tips for Engineers in the Oil and Gas Industry
For most engineers, getting a Green Card requires sponsorship from an employer. It also requires going through the lengthy “PERM Labor Certification” process.
The good news, however, is that many engineers can qualify to submit a National Interest Waiver (NIW) case, which can be field directly by the engineer without sponsorship by an employer.
In order to qualify to submit a National Interest Waiver the engineer must have a PhD, a Master’s Degree, or the equivalent of a Master’s Degree (a Bachelor’s Degree plus five years of professional experience). This “equivalency” rule enables many engineers—especially those who have generated numerous technical reports–to take advantage of the National Interest Waiver (NIW) option.
